By accessing or using SeaWise ("the Service"), operated by JK Yacht Ops ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

SeaWise is a maritime voyage planning tool that provides port-to-port distance calculations, fuel consumption estimates, travel time projections, and cost estimates. The Service also includes AI-powered route generation and a global fuel price tracker. The Service is available as a web application and mobile application.

3. Advisory Nature of Calculations

SeaWise provides advisory estimates only. All distance calculations, fuel consumption figures, travel time estimates, cost projections, and AI-generated routes are approximations intended to assist with voyage planning. They should not be relied upon as the sole basis for navigation decisions.

Users must:

Consult official ECDIS charts and maritime publications for navigation
Verify fuel consumption against actual vessel performance data
Confirm fuel prices with suppliers before purchasing
Use professional judgement in all voyage planning decisions

4. User Accounts

To access certain features, you may create an account using your email address and password. You are responsible for:

Maintaining the security of your account credentials
All activity that occurs under your account
Notifying us immediately of any unauthorized use

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to gain unauthorized access to the Service or its systems
Interfere with or disrupt the Service
Use automated tools to scrape or extract data from the Service
Share your account credentials with others

6. Subscription and Payment

Access to SeaWise requires a paid subscription. By subscribing, you agree to pay the applicable fees. Subscriptions renew automatically unless cancelled. You may cancel your subscription at any time, and access will continue until the end of the current billing period.

7. Intellectual Property

The Service, including its design, code, content, logos, and the SeaWise brand, is the property of JK Yacht Ops and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from the Service without our written permission.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law, JK Yacht Ops shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, damages arising from:

Inaccurate distance, fuel, time, or cost calculations
AI-generated routes that may not reflect optimal or safe navigation paths
Fuel price data that may not reflect current market conditions
Service interruptions or data loss

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Service after changes constitutes acceptance of the modified terms.

12. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
